Child pornography (also referred to as Child Sexual Abuse Material or CSAM) includes any sexually explicit visual material involving a minor. Virginia Code § 18.2-374.1 defines this as material that:

Child pornography, also known as child porn or child sexual assault material, is sexually explicit visual material using an identifiable minor as its subject or depicts a minor, whether or not that minor actually exists, in a state of nudity or engaged in sexual conduct where such depiction is obscene.

A "minor" is defined as any individual under 18 years of age.


2. Is Possession of Child Pornography Illegal in Virginia?

Yes. Under Virginia Code § 18.2-374.1:1(A), knowingly possessing child pornography is a Class 6 felony. A second or subsequent offense is elevated to a Class 5 felony under § 18.2-374.1:1(B).

Penalties for Possession of Child Pornography:

  • First Offense (Class 6 Felony):

    • 1 to 5 years in prison, or

    • Up to 12 months in jail and/or a fine up to $2,500 (if sentenced by the court without a jury)

  • Second or Subsequent Offense (Class 5 Felony):

    • 1 to 10 years in prison, or

    • Up to 12 months in jail and/or a fine up to $2,500

All convictions require Tier I sex offender registration for a minimum of 15 years under Virginia Code § 9.1-902. Conviction of more than one offense requires lifetime registration.


3. What Are the Penalties for Distribution of Child Pornography in Virginia?

Virginia Code § 18.2-374.1:1(C) prohibits distributing or reproducing child pornography.

Penalties:

  • First Offense:

    • 5 to 20 years in prison

    • Mandatory Tier II sex offender registration

  • Second or Subsequent Offense:

    • 5 to 20 years in prison

    • Mandatory minimum sentence: 5 years (served consecutively to any other sentence)

    • Mandatory Tier II or Tier III sex offender registration depending on the circumstances


4. What Are the Penalties for Production of Child Pornography?

Virginia Code § 18.2-374.1(C1) and (C2) set out penalties for the production of child pornography depending on the age of the minor and age gap between the accused and the victim.

Examples of Penalties Include:

  • Minor under 15 years old, First Offense: 5–30 years in prison

  • Minor under 15, Offender 7+ years older: 5–30 years (5-year mandatory minimum)

  • Minor 15–17 years old, First Offense: 1–20 years

  • Minor 15–17, Offender 7+ years older: 3–30 years (3-year mandatory minimum)

  • Second or subsequent offenses: Mandatory minimums range from 10 to 15 years, with maximums up to 40 years

All convictions require lifetime Tier III sex offender registration.


5. What Evidence Is Used in Child Pornography Cases?

Evidence often includes, but is not limited to:

  • Forensic examination of digital devices (phones, laptops, tablets)

  • Recovery of deleted files and internet history using tools like Cellebrite and GrayKey

  • Testimony from law enforcement or forensic analysts

  • IP address tracking and online chat logs

  • Statements made by the accused (voluntary or during interrogation)

Possession cases hinge on proving the accused had knowing control and awareness of the content on their device.
